General Terms and Conditions (GTC) of LuxyLab

1. Scope

The following terms and conditions apply to all orders placed through our online shop. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity. A business is a natural or legal person or a partnership with legal capacity that, when entering into a legal transaction, acts in the course of its commercial or independent professional activity.

2. Contracting parties, conclusion of contract

The purchase agreement is concluded with LuxyLab.de

The presentation of products in our online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order. By clicking the order button, you submit a binding offer for the goods contained in your shopping cart. Confirmation of receipt of your order will be sent by email immediately after you submit it.

We will accept your offer within two days by sending a confirmation email or by delivering the goods.

3. Contract language, contract text storage

The language available for concluding the contract is German. We do not save the contract text.

4. Delivery conditions

We offer free shipping within Germany. Shipping is exclusively via mail. In-person pickup of goods is unfortunately not possible.

5. Payment

The following payment methods are generally available in our shop:

  • credit card
    During the ordering process, you will enter your credit card details. Your card will be charged immediately after you submit your order.

  • PayPal
    You pay the invoice amount via the online payment provider PayPal. You must be registered with PayPal or register and authenticate yourself with your login details. You will receive further instructions during the ordering process.

  • Klarna
    In cooperation with Klarna, we offer you the following payment options (where available in your country):

    • Purchase on account
      Payment is due within 30 days of shipment. You can find the full terms and conditions for purchasing on account with Klarna here .

    • Instant bank transfer
      Your account will be debited immediately after you place your order.

    • installment purchase
      With Klarna, you can conveniently pay for your purchase in fixed or flexible monthly installments. Further information can be found on the Klarna website.

    Using Klarna payment methods requires a positive credit check. Please refer to the Klarna terms and conditions for further details.

6. Retention of title

The goods remain our property until full payment is received.

7. Transport damage

If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately.

8. Warranty and Guarantees

The statutory warranty rights apply. Information on any additional warranties and their exact terms can be found with the product and on dedicated information pages in the online shop.

9. Liability

We are always liable without limitation for claims arising from damages caused by us, our legal representatives or agents:

  • in case of injury to life, body or health,

  • in the case of intentional or grossly negligent breach of duty,

  • in the case of warranty promises, if agreed, or

  • insofar as the scope of application of the Product Liability Act is opened.

In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations), due to slight negligence on the part of us, our legal representatives or vicarious agents, our liability is limited to the amount of the foreseeable damage that typically arises at the time of conclusion of the contract.

Furthermore, claims for damages are excluded.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/ . We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final Provisions

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If the customer is a consumer and does not have a residence in Germany, the application of mandatory provisions of the state in which the customer has their habitual residence remains unaffected.

Should individual provisions of these Terms and Conditions be or become wholly or partially invalid, the validity of the remaining provisions shall not be affected. The statutory provisions shall apply in place of the invalid provision.
